Terms of Use

These terms are an agreement between you and Crossbuck ("we", "us") for the Crossbuck app and the crossbuck.app website ("Crossbuck"). By using Crossbuck, you agree to them. If you don't agree, please don't use Crossbuck.

Safety comes first

Crossbuck gives you information. It does not control traffic, trains or crossing signals, and it can be wrong.

• Always obey traffic laws, signals, gates and railroad crossing warnings. Never try to beat a train, and never go around lowered gates.
• Don't handle your phone while driving. Set Crossbuck up before you drive, and rely on its spoken alerts on the road.
• Information can be wrong, late or missing. A crossing Crossbuck shows as clear may be blocked, and one it shows as blocked may have cleared.
• Crossbuck is not an emergency or safety system. In an emergency, call 911. If a vehicle is stuck on the tracks, get everyone out and away, then call the emergency number on the blue sign posted at the crossing.

How Crossbuck works

Crossbuck combines public data from the Federal Railroad Administration with anonymous signals from drivers using the app. It shows crossings that appear blocked and crossings that are often blocked, and it estimates delays. These are estimates, not confirmed train information. Crossbuck is not affiliated with the Federal Railroad Administration or any railroad.

Your account

You can use Crossbuck as a guest, or sign in with Apple or Google. Keep access to your device and sign-in account secure; you're responsible for activity on your account. You can delete your account at any time in the app under Settings. You must be at least 13 to use Crossbuck.

Acceptable use

You agree not to:

• send false or misleading data, for example by faking your location to create or clear blockages;
• scrape, copy or resell Crossbuck's data or services without our written permission;
• interfere with, overload or try to break Crossbuck's security;
• reverse engineer the app, except where the law allows it; or
• use Crossbuck for anything unlawful.

We may suspend or close accounts that break these rules.

Your data and contributions

Using Crossbuck generates crossing events that help other drivers. You give us permission to use them to run and improve Crossbuck, and to create aggregate, de-identified statistics, which we may publish or share. Our Privacy Policy explains how we handle personal information.

Other services

Crossbuck can open Google Maps or Apple Maps to suggest a route. Those services, the app stores, and the Apple and Google sign-in services have their own terms, and we're not responsible for them. If you got the app from Apple's App Store, Apple's Licensed Application End User License Agreement also applies.

Our property

Crossbuck, including its software, design, name and logo, belongs to us. We give you a personal, non-transferable right to use the app for its intended purpose. If you send us feedback, we may use it without any obligation to you.

Disclaimers

Crossbuck is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, including warranties of accuracy, availability, merchantability or fitness for a particular purpose. We don't guarantee that any crossing is clear or blocked, that any route saves time, or that Crossbuck will be available without interruption.

Limitation of liability

To the fullest extent the law allows, we're not liable for indirect, incidental, special or consequential damages, or for delays, missed appointments or lost time, arising from your use of Crossbuck. Our total liability for any claim about Crossbuck is limited to $100. Some places don't allow these limits, so they may not all apply to you.

Changes and ending these terms

We may update these terms. If a change is material, we'll tell you in the app or on this page before it takes effect; continuing to use Crossbuck after that means you accept the updated terms. You can stop using Crossbuck at any time, and we may stop offering it.

Governing law

These terms are governed by the laws of the State of Texas, and disputes will be resolved in the state or federal courts located in Texas, except where the law where you live requires otherwise.
